Examining Marijuana ArrestsThe New York State Legislature showed good sense when it exempted people convicted of low-level marijuana possession from having to submit DNA to the state database, unless they have been convicted of a previous crime. Still, the state must do more to curb the arrests of tens of thousands of people each year in New York City for minor possession of marijuana, despite a 1977 state law that decriminalized it.

Trouble With Marijuana Arrests (September 27, 2011)

State data show that the New York Police Department arrested more than 50,000 people last year for low-level possession, with about 30 percent having no prior arrest record. More than 11,700 of those arrested were 16- to 19-year-olds; nearly half had never been arrested before and 94 percent had no prior convictions.

Under the 1977 law, possession of 25 grams or less of marijuana is a violation, subject to a $100 fine for the first offense. But possession of any amount that is in public view is a misdemeanor punishable by up to three months in jail and a $500 fine. Civil rights lawyers say that many of those stopped by city police were arrested after officers told them to empty their pockets, which brought the small amount of drugs into view.

The Bronx Defenders, a public defender agency in that borough, reported last week that it had examined the cases of 518 people arrested for low-level possession in 2011 and concluded that 40 percent of them were unlawfully arrested or charged.

Marijuana arrests declined after passage of the 1977 law, but that changed in the 1990s. Between 1997 and 2010, the city arrested 525,000 people for low-level, public-view possession, according to a legislative finding. Lawmakers and civil rights lawyers are rightly outraged that more than 80 percent of those arrested in the city are black and Latino, despite substantial data showing that whites are more likely to use the drug. Bills pending in both the Senate and the Assembly could help reduce the inequity in the law by making public possession of a small amount a violation instead of a misdemeanor

Doctor Arrested for Illegal Prescriptions

Doctor, clinic owner accused of running pill mill

A doctor, a clinic owner and a clinic employee were arrested today for illegally selling prescriptions of oxycodone and Xanax, totaling more than 35,000 pills, the Tampa Police Department said.

Paul Awa, a former doctor at JW Wellness, 233 W. Waters Ave., Tampa, clinic owner and manager Wade Leath, 37, of Tampa, and employee Evette Cabado, 20, of Tampa, were all arrested today, police said.

All three have been charged with racketeering, conspiracy to commit racketeering and conspiracy to traffic in a controlled substance, police said.

Earlier this year, police received complaints from citizens about the clinic. Police sent undercover officers and informants to the business and performed surveillance.

In August, investigators executed a search warrant and seized the records of 79 patients. Investigators learned that the clinic had fraudulently written prescriptions, issuing 31,000 oxycodone pills and 6,000 Xanax pills, said Tampa police Assistant Chief Marc Hamlin.

"The doctors were prescribing these pills outside the scope of professional practice and also outside the scope of the medical standard of care," Hamlin said.

The clinic was accepting fraudulent MRI's and fraudulent prescription histories from customers, Hamlin said.

Drug traffickers would also sponsor "fake patients" to go into the clinic to obtain pills, Hamlin said.

"We're equating this oxycodone issue to crack in the 80s," Hamlin said. "It's taking lives and destroying families at a scary rate."

After police executed the search warrant at JW Wellness in August, Awa, 59, of Oldsmar, went to work at Main Street Medical in Thonotosassa. He was arrested Wednesday at the clinic and investigators executed a search warrant on Main Street Medical.

Police also arrested three Bradenton men they said recruited patients to illegally buy pills at JW Wellness. Edward Smith, 35, Trevor Mercer, 29, and Jeremy Paul, 34, were charged with racketeering, conspiracy to commit racketeering and conspiracy to traffic in a controlled substance.

Jason Bliebtrey, a co-owner of JW Wellness, was also charged with racketeering, conspiracy to commit racketeering and conspiracy to traffic in a controlled substance. Bliebtrey, 31, is currently serving 18 months at the Suwannee Correctional Institute in Live Oak after being found guilty earlier this year of obtaining controlled substances by fraud.

Man Shot in Undercover Sting

Authorities identified the man who was shot in the arm by a Broward Sheriff's deputy during an undercover drug sting at a fast-food restaurant late Thursday, the agency said.

Justin Wade Tellis, 27, of Hollywood, was charged by the Broward Sheriff's Office with delivery of cocaine and attempted murder of a law enforcement officer, authorities said Friday.

According to two complaint affidavits written by Broward Sheriff's deputies, Tellis was paid $200 for two bags of crack cocaine that were sold to someone in his car shortly before 8 p.m. in the rear parking lot of a Taco Bell restaurant, at 357 W. Atlantic Blvd.

When uniformed deputies approached the car on foot to arrest Tellis, he drove at them at a high rate of speed, investigators said.

A deputy feared for his safety and fired five shots toward Tellis, an affidavit states. One bullet struck Tellis' left arm and he was taken to an area hospital for treatment, the Sheriff's Office said.

The agency said the name of the deputy who fired his weapon will be released next week, after he provides statements to Broward sheriff's investigators.

The deputy is on three days' administrative leave, which Broward Sheriff's spokesman Jim Leljedal said is "standard procedure after a traumatic incident."

TALLAHASSEE, Fla. –Attorney General Pam Bondi today announced the arrest of the owners of Best Value Homes, Inc. for conspiracy to commit RICO (the Racketeer Influenced and Corrupt Organizations Act) and organized fraud. Best Value Homes, Inc., misrepresented services by promising to modify their clients’ mortgages and taking the victims’ money without completing the promised services. The Florida Attorney General’s Office of Statewide Prosecution, 11th Judicial Circuit State Attorney’s Office, and Miami-Dade Police Department’s Mortgage Fraud Task Force partnered to arrest and charge the defendants. The total loss is estimated at $750,000 for 500 victims. If convicted of all counts, the defendants could be sentenced to terms of up to sixty years in prison.

“It is disgraceful that these criminals defrauded hundreds of Floridians who are merely trying to pay for their homes and shelter their families,” said Attorney General Bondi. “Telemarketing scams are a serious threat to Florida consumers, and we will continue to vigorously investigate and prosecute these lawbreakers.”

During approximately six months in 2008 and 2009, Best Value Homes, Inc. of Miami called itself a “Mortgage Loan Modification Company” and used telemarketing methods to solicit prospective clients. The company told the prospective clients that they could modify their existing home mortgage loans. The clients were required to sign a third-party contract, which makes no promises of a loan modification, giving the company permission to negotiate the mortgage loan with financial institutions. The clients were also required to pay an upfront fee ranging from $1,500 to $1,750. In Florida, legitimate loan modification businesses are required to be licensed by the Florida Office of Financial Regulation and are prohibited from requiring advance fees.

The company owners that were arrested and charged are: Ronald Rodriguez, Zoar Rodriguez, Berta M. Cabrera and Kellyd Rodriguez.
